TERMS AND CONDITIONS OF THE VICTORIA TENNISHAL FOUNDATION
Adopted and entered into force on March 15, 2021
Article 1: General Provisions

These Terms and Conditions apply to any agreement between Stichting Victoria Tennishal (hereinafter: “The Tennis Hall”) and the User (including legal representatives of minors).

These terms and conditions also apply to individuals who are not (yet) users but who participate in activities organized by or on behalf of De Tennishal.

If any provisions are found to be invalid, the remaining provisions shall remain in full force and effect. The parties shall then consult to agree on replacement provisions with the same effect.

Situations not covered by these terms and conditions will be assessed in accordance with the “spirit” of these terms and conditions.

Any deviations from these terms and conditions are only legally valid if they have been confirmed in writing by De Tennishal.
Article 2: The Agreement

Reservation: A contract is formed through a reservation made on the website.

Seasonal rental: Applications for the entire season must be submitted using the official registration form to
info@victoriatennishal.nl. Verbal or telephone requests will not be processed. -
Confirmation: Confirmation will be provided in writing or by email. The agreement is final upon written confirmation and payment.

Right of renewal: Seasonal renters have the first right to renew their contract for the same unit for the following season.

Changes: Any changes to your address or email address must be reported to the coordinator immediately.

Single-session rentals: In addition to seasonal rentals, single-session court rentals are available via www.victoriatennishal.nl.

Reservations by the Board: The Board may reserve court time for lessons, league play, tournaments, or events.
Article 3: Rates

Rates are set annually by September 1 at the latest and published on the website.

Rates are fixed for the entire season (September 1 through August 31).
Article 4: Payment

Billing: Seasonal renters will receive an invoice immediately after making a reservation. One-time rentals must be paid in advance via iDEAL.

Payment deadline: The invoice for seasonal rental must be paid in full before the start of the season. Failure to pay will result in the loss of playing privileges.

Reminder: A €2.50 administrative fee may be charged for a payment reminder.

Default: If the payment deadline is exceeded, the User is automatically in default. Access to the lobby will then be denied.

Collection fees: If payment is not received within 15 days of the reminder, out-of-court collection fees will be charged (minimum €40).

Suspension: In the event of non-payment, performance of the agreement will be suspended. This does not relieve the User of the obligation to pay for the current period.

Bailiff: If payment is not made after a demand for payment, the claim will be transferred to a bailiff.
Article 5: Access to the hall

Access is granted once the rent has been paid.

Guests may enter starting 5 minutes before the reserved time.

Once the time is up, please leave the court immediately to make way for the next group.
Article 6: Rules of Use and Conduct

Instructions: Instructions from management or staff must be strictly followed.

Footwear: You may only enter the court wearing clean indoor shoes (no black soles). Outdoor shoes are not allowed on the court; please bring your tennis shoes separately.

Refreshments: Drinking on the track is permitted only from water bottles or sealable plastic bottles. Smoking is prohibited.

Pets: Not allowed in the lobby.

Conduct: Players and spectators are expected to behave appropriately and in a sportsmanlike manner.

Trash: Small trash items must be disposed of in the designated trash bins.

Parking: Bicycles and cars must be parked only in the designated areas.

Penalties: Repeated violations may result in termination of the agreement without a refund.
Article 7: Liability and Damages

Disclaimer: Participation in sports activities is at your own risk. The Tennis Hall is not liable for any damage, injury, or death.

Insurance: The User is responsible for obtaining adequate health and liability insurance.

Limitation: If De Tennishal is nevertheless held liable, compensation is limited to the amount paid out by the insurer.

Health: The User declares that he or she is in good health and fit to participate in sports.

Property damage: The User will be held liable for any damage to the facility or property belonging to De Tennishal. In the case of groups, all members are jointly and severally liable.

Theft: The Tennis Hall is not responsible for any loss, theft, or damage to Users' property.
Article 8: Termination of the Agreement

Cancellation: Seasonal rentals may be canceled in writing or by email at the end of the season, with one month's notice.

Inappropriate behavior: In the event of physical or verbal abuse, harassment, or discrimination, the board may terminate the agreement immediately.
Article 9: Privacy

Personal data is processed in accordance with GDPR guidelines and used exclusively for central administrative purposes.

Data will not be disclosed to third parties unless required by law.
Article 10: Force Majeure

The Tennis Hall is not liable for any obligations in the event of force majeure (unforeseeable external circumstances).

In the event of force majeure lasting longer than one month, either party may terminate the agreement without liability for damages.
Article 11: Governing Law

All agreements are governed exclusively by Dutch law.

Disputes shall be submitted to the competent Dutch court, provided that the parties have first attempted to resolve the dispute through mutual consultation.
Article 12: Location and Amendments
-
The terms and conditions are available on the website and must be accepted when booking online.
-
The most recently published version on the website is always the current version.
-
In the event of changes, the User has the right to terminate the agreement on the date the new terms and conditions take effect.
